Terms & Conditions

All sales made by Frosted Sky Cakes are subject to the following terms and conditions:

Nothing contained within these terms and conditions affects your statutory rights as a consumer. Before confirming your order, we advise to read the following terms and conditions. By placing and paying for an order you agree to the terms and conditions stated below.

1.Price

1.1.The price for the order shall be stated on your invoice. You agree to pay the full price to Frosted Sky Cakes in accordance with the invoice after the details are checked and agreed by you. Quotes, either written or verbal are valid for 14 days.

 

2.Deposits and payment schedule 

2.1. All cakes require a non-refundable booking deposit of 25% of the total cost. Payment of the deposit confirms the comission of your cake and chosen collection/delivery date. Please note that all booking deposits are non-refundable and non-transferable.

2.2. All booking deposits require payment within 3 working days from the date the invoice is sent. The invoice will be sent once the design has been confirmed and the details checked and agreed by you. All orders are deemed to have been accepted only when the deposit has been paid and no dates will be held until the deposit is received.

2.3. Payment schedule is as follows:

  • Booking deposit: 25% non refundable deposit of the total cost required on booking.
  • For wedding cakes: 50% of the remaining balance is due 3 months before your event date
  • For all cakes the final balance is due 4 weeks prior to your event/collection date.
  • Orders placed for cakes with less than 4 weeks before the collection/delivery date require full payment at the point of order confirmation.

 

3.Payments

3.1.Payments may be made by bank transfer.

 

4.Final Payments

4.1.Deposit and remaining balance amounts must be paid by the date noted on the invoice. The order will not be completed if full payment has not been received by the specified date.

 

5.Non-Payments

5.1. In the event that any payment is subsequently declined, the order will not be completed until alternative funding arrangements have been agreed and payment is made in full. Subsequent completion of the order will be subject to availability and cannot be guaranteed. Frosted Sky Cakes accepts no responsibility for any loss caused for non-delivery under these circumstances. The customer will be responsible for the payment of any additional charges, which have been incurred as a result of payment failure.

 

6. Ordering from Frosted Sky Cakes and Cake Details

6.1. For wedding cakes: the cake samples that were posted out to you were made and cooked on a smaller scale.  The same flavours when cooked on a larger scale will vary slightly in colour, texture and flavour due to their size and time they were cooked for.

6.2.All of our cakes and products are handmade to order. During manufacturing, slight changes may occur with colours, textures, flavours and design which due to the nature of the work, are out of our control. These slight changes will not be significantly different form the specification and sketch of the design (if provided) created and specified at the initial stage of ordering.

6.3 The cake will be made according to the details provided on your invoice and therefore it is imperative that all details are checked carefully.  Any errors not picked up on the invoice before the cake is made will not be considered to be our error.

6.4. Any personalised decorative elements such as cake toppers, printed icing or cake charms, will be ordered as per the details on the invoice, so please check all name spellings and numbers carefully.

 

7.Alterations to orders

7.1 Please take the time to check your copy of the invoice (and sketch if one is provided) carefully and let us know if changes are needed. It is your responsibility to advise Frosted Sky Cakes of any alterations to the original order. Requests for alterations must be made in writing. Frosted Sky Cakes reserves the right to increase the quoted fee in the event that the customer requests a variation to the work agreed. Whilst every effort will be made to assist customers, please note that late changes cannot always be guaranteed.

7.2. The date of your final payment is the final date for any changes of size, style or flavors of the cake. Any changes requested after this date cannot be guaranteed and may be subject to additional charges.

 

8.Cake Component Parts

8.1. From time to time, certain materials for your order may become obsolete or no longer be available from our suppliers. For example, pre-manufactured items or ribbon colours. This is out of our control, however we will endeavour to redesign a cake to reflect as closely as possible the original design using replacement products. In such cases we will try to contact you to advise you of any such changes, however Frosted Sky Cakes reserves the right to replace these with components of equal or better quality without consultation.

 

9. Equipment Hire 

9.1. Should you wish to hire any of our equipment (e.g. cake stand, acrylic tiers) an £100 security deposit on top of the hire charge is required for all hired items. All hired cake stands and equipment must be returned to Frosted Sky Cakes within 3 days of the event they were used for and undamaged for the security deposit to be returned. 

 

10. Collection

10.1. Your order may be collected at a prearranged time from my home. A signature is required upon collection, confirming that you have received your order in good condition and as specified and that you have been made aware of the allergy information and inedible items on/in the product.

10.2.You will have the opportunity to check and approve your order on collection. Once the order has been collected and leaves the Frosted Sky Cakes premises, this indicates the acceptance of the goods. We do not take any responsibility for any damage that may occur to the cake once it has left us.

10.3. We advise cakes to be placed on a level, steady surface for transport e.g., in a clean, clear space in the boot of your car, on non-slip matting. The cake should then be stored in the box at room temperature and out of direct sunlight. 

10.4. Any cakes not picked up within 1 hour of the agreed collection time will be held for a maximum of 48 hours. A new collection time (and day) will be arranged at my convenience. Cakes not collected after this time may be disposed of.

 

11. Delivery and Venue Set Up

11.1. Should you require your cake to be delivered to your venue, Frosted Sky Cakes will deliver and set up your cake as agreed. It is your responsibility to ensure that you have provided Frosted Sky Cakes with the set-up details and arrangements made with the venue for the location and display of your cake. Frosted Sky Cakes cannot be held responsible for the location of the cake at the venue. Please ensure, therefore, that the display location is level, stable and strong enough to hold the cake.

11.2. Delivery charges are calculated on a mileage plus a set up fee and will be included on your invoice.

11.3. Frosted Sky Cakes cannot be held liable if the cake is affected by very hot weather. Buttercream cakes, such as those with a naked, semi naked or full coverage buttercream finish are most likely to be affected. We cannot take responsibility if the cake is ordered for the summer season or if it is positioned in direct sunlight or near a heat source.

11.4. Once the cake has been collected or delivered, set up and signed for, Frosted Sky Cakes is unable to accept liability for any interference with or damage to the cake thereafter. We will also not be liable if the cake is moved by and damaged by another party.

11.5. If we have previously agreed to meet with another supplier - for example, a florist providing fresh flowers for the cake – and they are late or do not arrive, Frosted Sky Cakes cannot be held liable for anything missing on the cake that was due to be provided by another supplier.

11.6. If a cake is delivered to an event venue and set up by Frosted Sky Cakes, a signature will be required by your venue management confirming the cake had been received and set up in good condition and that information on allegens and non-edible items has been received. A photograph of the cake will be taken prior to departure by Frosted Sky Cakes to verify that the cake has been set up and left in good condition. It is the management at the venue’s responsibility to let the relevant people know about the allegen and non-edible items information provided . If the cake gets signed for by the client, it is their responsibility to let the relevant people know. Frosted Sky Cakes cannot be liable if the information provided on delivery is not passed on.

11.7. You can be assured that we will always do our best to deliver as prearranged, but in the unlikely event we may be faced with a force majeure e.g. severe weather conditions, public unrest, or other unexpected event that is out of our reasonable control that may make delivery impossible. In this case, you would have to arrange to collect the cake yourself.

 

12. Non-Edible Elements

12.1. Sometimes our cakes will contain non-edible elements such as plastic dowels, flowers, or cake toppers.  We will advise you of any non-edible elements that need to be removed during cutting and provide written information about this to you/the venue.

12.2. As we will not personally be cutting the cake, we cannot accept any responsibility for any non-edible elements not removed prior to serving. 

 

13. Allergens & Special Dietary Requirements

13.1. Unless otherwise stated, all our cakes contain; gluten, butter and eggs and are made in an environment that handles allergens.  Gluten-free, nut-free, and dairy free cakes can sometimes be made on request; however, we cannot guarantee that these cakes will not contain trace amounts of these ingredients due to the nature of the product.

13.2. We would recommend anyone with a severe nut; dairy or gluten intolerance does not eat our cakes.

13.3 We will provide full allergen information with the cake upon collection/delivery. Frosted Sky Cakes accepts no liability for customers suffering allergic reactions from eating our cakes.

 

14. Unforeseen Circumstances and Force Majeure

14.1 In the unlikely event that I become ill or am affected by circumstances beyond my control  (e.g. power cut, fire) that mean I can no longer complete your order; a full refund will be given (including booking deposit). 

14.2 In the unlikely event that due to an Act of God/Force Majeure (e.g. severe weather conditions, public unrest) I can no longer complete your order; no refund will be issued.

 

15. Cancellations

15.1. Wedding Cake or Celebration Cake Cancellations: As your wedding cake/celebration cake is reserved solely for you and certain components for your cake/s may be ordered or made months in advance, the following conditions are implemented when an order is cancelled:

 

15.2. Wedding Cake Cancellations:

  • More than 8 weeks from delivery date: If work has started on your order or items have been ordered specifically for your order, it is up to the discretion of Frosted Sky Cakes to calculate the cost of ese materials/labour and that amount will be due.
  • 4-8 weeks from delivery date: 50% of the total costs will be payable to Frosted Sky Cakes.
  • 0 to 4 weeks from delivery date; 100% of the total costs will be payable to Frosted Sky Cakes.

 

15.3. Celebration Cake / Cupcake Cancellations:

  • More than 2 weeks from delivery date:  If work has started on your order or items have been ordered specifically for your order, it is up to the discretion of Frosted Sky Cakes to calculate the cost of these materials/labour and that amount will be due.
  • 2 weeks from delivery date : 50% of the total costs will be payable to Frosted Sky Cakes
  • 0 to 1 week from delivery date: 100% of the total costs will be payable to Frosted Sky Cakes.

 

15.4. All cake order cancellations must be made in writing.

 

16. Postponements

16.1 If you need to change your booking date, please let us know in writing as soon as possible.  Any changes are subject to availability and are not guaranteed. 

16.2 If Frosted Sky Cakes can accommodate your new booking date, a new booking fee of £50 will be payable to secure the new date.  The first booking fee will also be deducted off the final cost.

16.3. If Frosted Sky Cakes is unable to accommodate your new booking date, it will then be treated as a cancellation and the cancelation terms set out in section 15 will apply,

 

17. Publication and Promotional Rights

17.1. Frosted Sky Cakes reserve the right to use any image of a customer's cake made by us for publication / promotional reasons after the delivery date unless previously agreed in writing between the customer and Frosted Sky Cakes.

 

18. Complaints

18.1 Frosted Sky Cakes sincerely hopes you are happy with your cake. Complaints are very rare, however, we take them very seriously. Please inspect your cake on delivery/collection. Corrections and repairs to cakes including inscription mistakes, can be corrected on the same day in most cases.

18.2 If your complaint is about the quality of the cake, at least 75% of the cake must be returned within 2 days to ensure we are able to fairly assess the nature of the complaint and determine what course of action we will take. No refund will be given if the cake is not returned or has been eaten.

18.3 The maximum refund we offer is the value of the cake. Further compensation is not available. All deposits/booking retainer fees are non-refundable.

18.4 Any refunds will be given entirely at our discretion.
